How should I file my return if my spouse recently died?

Per the IRS

According to the IRS, if someone dies, their surviving spouse or representative files the deceased person's final tax return. The surviving spouse or representative will indicate that the person has passed away on the final tax return. There is no additional notification of the death required by the IRS.

 

If you were able to file married filing jointly with your spouse while they were alive, you will be able to file again as married filing jointly if they died within the tax year you are filing for.

 

If they died within the past two years, you may be a candidate for the Qualifying Surviving Status status.

 

Documents to include

Non-court appointed representatives must comprise Form 1310, Statement of Person Claiming Refund Due a Deceased Taxpayer in order to get a refund. However, this form does not need to be filled out by surviving spouses or representatives chosen by the court.

 

The death certificate or any other form of death proof is not required by the IRS, though there may be documentation required at the state level
